Minimum qualification for Telecom Mechanic exam – Supreme Court dismisses BSNL’s SLP 

According to the Recruitment Rules of the Telecom Mechanic, 10th standard qualification is necessary for a Regular Mazdoor to appear the Telecom Mechanic exam (LDCE). Whereas, there is no such condition for a Group ‘D’ employee to appear the said exam. BSNLEU has demanded the management to remove this discrimination. This issue was discussed in the last National Council meeting, but management did not settle the issue fully. Meanwhile, a Regular Mazdoor by name D. Veeramani, from Krishnagiri in Tamil Nadu Circle, who does not possess 10th std. qualification was permitted by the CAT Chennai Bench to appear the Telecom Mechanic exam. The official passed the exam and demanded posting as TM. But the management rejected his demand and appealed against the CAT order in the High Court, which was rejected. Finally management filed an SLP in the Supreme Court, against the CAT order. However, the Supreme Court dismissed the SLP filed by the management.

ITS Absorption – BSNL should implement the High Court Order

 

The judgement of the Delhi High Court for a final disposal of the ITS absorption issue is welcome. For at least the last 5 to 6 years, the issue has been continuing without any final settlement. This has seriously and adversely affected the development and expansion of the company in an unprecedented manner. The company is in loss for the last three years and the top management is answerable. Along with the anti-PSU policy of the government, the uncertainty about the future of the ITS has demoralised the top officers to a very large extend which had its own repercussions in the functioning of  the BSNL. This situation can not continue, if the BSNL has to survive. It is informed that the BSNL management is trying to approach the Court to get more time for the repatriation, on the plea that the services of these officers are indispensable. Similar was the argument by the Britishers that Indians can not rule the country on their own. It is only a fragile argument. There are sufficient ITS officers who have opted for BSNL who can be posted in the important posts. Even if more is necessary, senior and efficient executives can be posted. The Pitroda committee recommendations in this connection is relevant. Less than 100 senior officers are sufficient to man these posts. The BSNL management should stand for the company from which they get their salary and not for those who want to leave the company for their career prospects. We don't have anything against the ITS officers who want to get repatriated for better prospects.  The issue is very simple.  If they want BSNL, BSNL  wants them. If they do not want BSNL, naturally BSNL also do not want them. The BSNL Management has to rise to the occasion and has to settle the issue in the interest of BSNL. Any lapse on this will never be condoned or pardoned by the workers or the people of this country who  want BSNL to survive and serve the people.

Order was issued by Corporate Office today to CGMT Kerala to implement the judgment of CAT Ernakulam on pay anomalies to all the 192 officials of Kerala Circle who got such judgment. For all other similarly placed officials the pay anomaly committee has to recommend the procedure. The date for the meeting is likely to be fixed soon. 

Rs. 550 crore arrears to BSNL from Private telcos

Private telecom companies are earning good profit. BSNL is in financial difficulty and is taking loan from the banks. But the private companies owe more than Rs. 550 crore to BSNL  on Inter-Connect Usage Charges (IUC) and have not paid it. The list is headed by Bharti Airtel with Rs. 169.07 crore, Idea Rs. 121.36 crore and Reliance with Rs. 101.63 crore. Almost all private companies have dues to be paid. The details are given in  reply to a Parliament question in Parliament. But what the BSNL management is doing in this case? What is the action taken by it to recover the amount? Even when the company is approaching banks for loan, why immediate actions are not taken to recover the amount?It is of utmost important that these arrrears are collected at the earliest.

BSNL takes loan of Rs.1383 crore

Times have changed for BSNL. From  an annual revenue of Rs. 40,000 crore and profit of Rs. 10,000 crore and a surplus cash of about Rs. 35,000 crore in Banks in 2005-06, BSNL reached a position in 2011- 12 posting a loss of about Rs. 8,000 crore. The downfall has been mainly due to the anti-PSU policy of the government and the utter inefficiency of the BSNL Management. Rather we can say, complete mismanagement. Revenue has come down and from 2006-07 company had started becoming in loss. And for the first time, for day-to-day expenses, BSNL has started taking loan. So far it was a debt-free company. But after taking the present loan of Rs.1383 crore from Union Bank, it has become an indebted company. Since BSNL has posted loss for three consecutive years, even the ‘Mini Ratna’ status awarded to it may be taken back. It is a serious situation. We have to take urgent steps to ensure that the government takes pro-BSNL decisions and the management is compelled to perform so that development and expansion work is done. The mindset of the workers also should be raised to higher levels. There is no time to waste.

ITS absorption – Delhi High Court judgement

Delhi High Court has given judgement on 17-04-2012 in the petitions filed by certain ITS officers. The main points in the judgement are reproduced below:

i) The deemed date of absorption of the petitioners fixed as 1.10.2000, is held to be illegal, being contrary to Rule 37-A (4) of CCS (Pension) Rules;

ii) The deemed date of permanent absorption of such of the petitioners who seek permanent absorption in BSNL/MTNL shall be 8.12.2005;

iii) The petitioners before this Court are given an option, to be exercised within two weeks from the date of this order, to revert to the Government or to seek permanent absorption in BSNL/MTNL as the case may be;

iv) Those Government servants who have already accepted permanent absorption w.e.f. 1.10.2000 will not be entitled to exercise a fresh option in terms of this order;

v) BSNL/MTNL shall relieve such of the petitioners, who opt to revert to Government service within 2 weeks of receipt of options from them;

vi) Such of the petitioners who opt to revert to the Government shall be appropriately redeployed by the Government in Government service through surplus cell of the Government. We have no doubt in our mind that the Government would not like to keep such of the petitioners who opt to revert to the Government idle and, subject to availability of the positions with it, give them such work as is deemed appropriate to be performed by them.

TRAI recommends for Unified Licence for services

 

The TRAI has now recommended that all the communication services may be given a unified licence the entry for which it recommended as Rs. 15 crore. The licence fee for spectrum will be different. The spectrum /air-waves will be allotted through auctions. At present an entry fee of Rs. 1658 crore  includes 4.4 MHz of start-up spectrum  or 2.5 MHz of CDMA  air waves for all the 22 circles.  As per the new recommendations, there will be no bundling with spectrum/airwaves. TRAI has also recommended that the penalty for violation of licence conditions etc. be reduced from the present Rs. 20 crore to Rs. 10 crore.

The sincere and excellent work being done by the Association have been much appreciated by the BSNL workers and pensioners. Most of the retiring BSNL workers are happy to become the AIBDPA members since they know from their  own experience that BSNLEU and AIBDPA are the organisations safeguarding their interests.

No increase in IDA from April 2012

 

With the 7% increase for the Central government employees from January 2012, PSU employees were waiting for a good increase from April 2012. The DA increase from January was given earlier to them.

It has now been informed that there is no increase in IDA for PSU employees w.e.f. April 2012. It will continue at 56.7% till June, when a revision is to take place.

Census 2011 and upgradation of cities for HRA

 

In the PSUs, upgradation of cities are decided purely on the basis of the population, unlike in the Central Government where certain other criteria are also considered. Those cities which cross 5 lakh poulation are treated as B class cities with 20% HRA and those crossing 50 lakh are treated as A class with 30% HRA. Less than 5 lakh are treated as C class with 10%.Now the census 2011 has been released and some cities might have crossed 5 lakh. CHQ has already taken with the management for upgradation of the cities, which are justified.

KG Bose Bhawan, the CHQ building of BSNL Employees Union has been inaugurated by Com. A.K.Padmanabhan, President, CITU in a largely attended meeting at West Patel Nagar, somewhat near to  Dada Ghosh Bhawan. Coms. Indian telecom is a few steps near 4G LTE mobile broadband revolution

The Indian mobile industry is set to witness 4G LTE mobile broadband auctions in the next 12-18 months. Equipment vendors like Ericsson, Nokia Siemens, Alcatel-Lucent, Huawei, Samsung and ZTE will be vying for the big opportunity. The initial steps were taken by an Empowered Group of Ministers (EGoM) headed by Finance Minister Pranab Mukherjee, and attended by Home Minister P Chidambaram, Defence Minister A K Antony, Telecom Minister Kapil Sibal, Planning Commission Deputy Chairman Montek Singh Ahluwalia, Information & Broadcasting minister Ambika Soni, when they decided to allocate 700 Mhz spectrum for offering 4G telecom services. While BWA spectrum winners who received spectrum in 2010, will be launching TD LTE services during 2012-13, winners of 700 Mhz are likely to bet on both FD LTE and TD LTE technologies, both of which are more prominent in the global LTE industry.

International Women's Day

International Women’s Day was observed all over Kerala with different programmes. Meeting of woman comrades conducted at Circle Office Trivandrum. Dr P.S.Sreekala State Leader, Vanitha Saahithi inaugurated. Recent atrocities against women in Kerala was widely focused. Com Janaki Chairperson Mahila Committee presided over the function. Several woman comrades including from executives and other various unions attended the meeting. Women comrades Com P.A.Sajeemi, Convenor Mahila committee welcomed and Com. Pankajam said vote of thanks. Com. Anna Ramachandran addressed the meeting. Circle Secretary K.Mohan, District Secretary C.Santhosh Kumar and other office bearers also attended.

TRAI suggests Rs.600 crore aid for BSNL 

TRAI has told the DoT to provide an adhoc subsidy of Rs.600 crore to BSNL. This amount will be paid from the USO Fund. BSNL is spending around Rs.9000 crore per year as operational expenditure to run its rural landline services. To make good this loss, BSNL has sought government’s support. As per reports, TRAI will study BSNL’s demand and will decide on the annual subsidy.

BSNL instructs field offices to speed up pension cases.

The continued efforts of the BSNLEU and AIBDPA is having some results. In the National Council and Standing Commitee meetings, we have been continuously raising the delay in settlement of pension cases after retirement. Though there is clear orders to settle all the retirement claims on the last working day itself, in many places the cases are sorted out after two-to-three months and some time more. This is causing much heart-burning and difficulty for the pensioners who have been serving for 30-40 years for the government and the people.

Now the BSNL Corporate office has issued an order asking the CGMs/Field officers to prepare everything ready before the retirement so that the claims could be settled without any delay.

BSNL, which recently launched extremely low cost tablets along with two mid range tablets, has got a tremendous response from Indian consumers. CBI files case against Kuldeep Goyal, former CMD BSNL 

CBI has filed a case against Kuldeep Goyal, former CMD BSNL. The CBI has also filed cases against three more BSNL officers, viz., R.K.Agarwal, Director, Consumer Mobility, Pradeep Narang, the then General Manager and Anil Kumar, the then DGM, (Strategic Planning). These officers have allegedly caused a loss of Rs.535.50 crore to BSNL. It is alleged that these officers entered into a criminal conspiracy and abused their official position and facilitated the award of Leased Service Area (LSA) contract for development of WiMax services to StarNet Communications, considered to have close links with A.Raja. It is alleged that StarNet Communications did not have the required qualification of Rs.100 crore turnover for the last 2 years.

No need to file tax returns for salaries up to Rs. 5 lakh

The Central Board of Direct Taxes (CBDT), has informed that individuals with a total salary income of Rs. 5 lakh in the financial year 2011-12 need not file tax returns for the assessment year 2012-13. However he will have to obtain a certificate of tax deduction in Form No. 16. This relaxation is continuing since last financial year ( 2010-11).

It is now reliably learnt that one more JAO exam will be conducted in the old syllabus.

BSNL’s revenue increases by 4.56% 

The revenue of BSNL has increased by 4.56% for the period from April to December 2011, compared to the period from April to December 2010. It is a good news that the erosion in BSNL’s revenue has been checked, and a slight increase has been made. This gives hope to us, that if all of us make sincere efforts, BSNL will definitely become a profit making company once again. Let us strive for it.

Conduct protest demonstrations on 10.01.2012, as per the call of the JAC,  

(a)   to demand severe action on the 5 private operators who cheated government and provided 3G service in circles where they have not acquired 3G spectrum, and thereby caused heavy loss to the govt. 

(b)   to demand immediate refund of BWA spectrum amount. 

DOT proposes penalty of Rs. 1594 crore on private telecom companies.

The DOT is proposing to impose Rs. 1,594 crore penalty on 6 private telecom companies for understating their revenues and cheating the government crore of rupees by paying less revenue share. The companies and the penalty proposed are as follows:

1. Bharti Airtel      : Rs. 292 crore                            2. Vodafone          : Rs. 254 crore              

3. Tata Teleservices        : Rs. 73 crore                   4. Reliance            : Rs.  551 crore           

5.  Idea Cellular   : Rs. 113 crore                           6. Tata Communications: Rs.120 crore

It is always known that the private telecom companies have been violating rules and regulations and tutilising all opportunities to increase their profit. The government was also succumbing to their pressure and granting a lot of concessions, though fully unjustified. The present of the proposal of the government has been overdue since it was well-known that the companies were cheating all these years and the government was looking the other way.

IDA may increase by 4.7% w.e.f. 01-01-2012 – Orders yet to be issued.

 

IDA is likely to be increased by 4.7% for revised pay w.e.f.01-01-2012. In the pre-revised pay, it may be 8%. Accordingly in the revised pay the IDA will be 56.7% and in the pre-revised 164.6%. Orders are yet to be issued.

How BSNL can spend Rs. 4,000 crore for VRS?

It has been reported in the media that CMD BSNL R.K.Upadhyay stated that for offering  VRS an amount of Rs. 4,000 crore can be spent by BSNL and the rest ( about Rs. 14,000 crore) has to be provided by DOT. For one thing, if the entire proposed amount of Rs, 18,000 crore is given for BSNL, it can develop and expand and the company will become financially viable. The cash crunch can be made good.  So why spend for VRS when that amount can be utilised for better purposes?

Secondly, from where BSNL is going to spend Rs.4,000 crore for VRS? How can BSNL spend the money for VRS instead of development?

The management has to answer these vital questions before proceeding with VRS.

What is the justification for BSNL Management to deny Bonus, 78.2% IDA fixation?

Two out of the 7  demands in the 15th December Strike are 1) Payment of Bonus and 2) 78.2% IDA fixation for BSNL Employees. BSNL management is denying both stating there is no money.he denial justified?

No. There is no justification to deny the demands. As far as Bonus is concerned, it is given in the government and the PSUs? It is a right won by the workers. On a scheme decided by the DOT, BSNL and MTNL managements without participation of the workers' representatives, Bonus can not be denied.

78.2% is granted by Government and PSUs? Why it is denied to BSNL workers alone.

The negative attitude of the BSNL management by denying the rights of the workers is the reason for the BSNL workers strike. They are fully responsible for the same.
